Under general supervision, performs professional legal work related to labor and employment matters involving the District; and may act as lead negotiator for the District in negotiation with labor organizations.

ESSENTIAL FUNCTIONS may include, but are not limited to the following: Acts as lead negotiator for the District in labor and employment matters involving the District. Confers and coordinates with the General Manager and other designated staff in the formulation and implementation of labor and employment policies for the District. Handles and/or monitors labor and employment related litigation in state and federal courts, in administrative tribunals, and in labor arbitration for the District. Assures District compliance with judgments, settlements, decrees and other legal orders. Provides legal advice and consultation to District staff, as required. Renders legal opinions requested by the General Counsel, or Assistant General Counsel. Assists in the interpretation, implementation, and administration of labor contracts; District administrative policies pertaining to labor and employment law; and compliance with applicable state and federal law. Drafts and analyzes resolutions, memoranda, contracts, and other legal documents. Exercises discretionary and independent judgment commensurate with the acquisition of specialized legal skills and experience. May be required to temporarily replace or act in the position of the senior District staff member to whom this position normally reports, and may be required to perform some or all of the senior staff member's essential functions in such situations. Performs related duties as required.

Negotiation strategies and principals of labor contract implementation; trial procedures, strategies, legal principles, and appellate practice in labor and employment law; principles, methods and practices of legal research and investigation, judicial procedure and the rules of evidence; and basic supervisory principles and practices.

Ability to: Negotiate union contracts, and labor disputes and grievances such as wage and hour; analyze and apply legal principles and precedents to specific legal problems; perform legal research; evaluate alternatives and make sound recommendations; prepare clear, concise, and complete legal documents, reports, correspondence and other materials; exercise initiative and independent judgment; make effective court, hearing, and public meeting presentations; represent the District effectively in meetings with others; and establish and maintaining effective working relationships with others contacted in the course of the work using principles of good customer service.

Unions get their legal standing from the National Labor Relations Act (NLRA) to provide collective bargaining leverage for workers with respect to workplace practices established by their employers. While you as an individual employee may not have much bargaining power, a union of employees has greater strength when negotiating with an employer as well as through the use of structured grievance procedures for resolving disputes. Your employer cannot interfere with your protected right to join or organize a union on behalf of co-workers and the employer cannot restrain or coerce you when you exercise your rights to promote a union.

Though it covers most workers, employees who are not covered include: railroad and airline employees, government employees, managers, farm workers, members of an employer's family, domestic workers, and independent contractors. Railroad and airline workers are covered under the Railway Labor Act, and Title VII of the Civil Service Reform Act regulates the work situations of those excluded from coverage under the NLRA.
