Wyoming State Bar Launches Lawyers' Assistance Program

CHEYENNE - The Wyoming State Bar today announced a partnership it has developed with the Wyoming Professional Assistance Program (WPAP) to help Wyoming attorneys whose professional performance may be impaired due to alcohol abuse, drug dependency, or mental health problems.

WPAP provides for confidential identification, peer intervention and rehabilitation of any Wyoming attorney whose professional performance is impaired because of physical or mental illness, including chemical dependency and alcoholism. WPAP is not a treatment program. The Bar is proud to provide this service to Wyoming lawyers,” said Joseph B. Bluemel, President of the Wyoming State Bar. “This confidential service will not only help save the lives and practices of the impaired attorneys, but it also contributes to the protection of the public.

When possible, the Bar attempts to address problems before they interfere with the service a lawyer provides a client or jeopardize a lawyer’s practice. WPAP has a clear understanding that addiction and behavioral problems stretch beyond the work environment, and strives to provide assistance before family and personal relations are put at risk. The Bar leadership takes the integrity and reputation of the legal profession very seriously,” said Bluemel. “The Bar has assumed the responsibility to provide the legal community with resources it needs and can benefit from. We are hopeful that impaired attorneys will take advantage of this confidential service and get the help they deserve.

How To Work with Your Lawyer.
Once you have selected a lawyer, there are several steps you can follow to help your lawyer and to satisfy yourself concerning the quality and expediency of legal services being provided. Here are some:
Be honest with your lawyer; tell the truth. An attorney can't be expected to give you well reasoned legal advice if the information you provide is faulty.
Tell your lawyer every fact that is relevant to the situation, even if it doesn't appear to be in your favor.
Have your lawyer analyze your case and give you both the positive and the negative aspects.
Take your lawyer's advice; it isn't given off-the-cuff. Don't waste your money or your lawyer's time if you don't have confidence in his or her special knowledge and skills.
Don't expect your attorney to give a simple answer to a complex question. Many legal problems cannot be explained simply. Be sure that you understand the technical language contained in wills, contracts, leases, and so forth. Don't, however, challenge your lawyer on every sentence on every page.
Keep your lawyer fully informed of any new developments that might affect your case.
Don't badger your lawyer. Respect your attorney's time. Avoid phoning repeatedly about petty matters. Remember, a lawyer has other clients who require attention too.

Ask your lawyer to keep you informed about the progress of your suit or legal problem. The lawyer is retained to work for you. Be skeptical of attorneys promising certain results. Airtight cases just don't exist. Request copies of all letters and documents prepared on your behalf. Don't sign any document or paper until you fully understand what you are signing.

How Do You Solve Problems with Your Lawyer?
If you have a fee dispute with your lawyer, consider arbitration as an option. If you find or suspect a lawyer's conduct to be unethical, you should file a complaint with the Supreme Court Disciplinary Counsel's office. The state Supreme Court may disbar, suspend, or censure a lawyer for unprofessional conduct.

Under no circumstances should you feel it necessary to continue to be represented by a lawyer, but don't act hastily. Often a conference with the lawyer can ease your concerns. He or she may not be aware of your dissatisfaction. It is always your choice about which lawyer you want to represent you. And note: a dismissed lawyer may be entitled to a fee for services actually rendered.

Should you decide to discontinue using your lawyer, that lawyer has certain obligations and duties to you such as returning all documents and papers in possession, filing the necessary withdrawal stipulations with the court and helping your new lawyer become familiar with your case.
